General Terms and Conditions

1. Scope of validity, contractual partners and subject matter of the contract

These general terms and conditions apply to all contracts that you conclude with us, Vorwerk UK Limited, via our online shop.

In our online shop, we offer you household items and accessories.

Our offer is exclusively for consumers. Consumer means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession; 

2. Formation of Contract

The presentation of the products in the online shop does not constitute a legally binding offer, but rather, a non-binding online catalogue. Orders are only possible in customary household quantities. You may initially place our products into the shopping basket without obligation and check your entries at any time prior to submitting your binding offer, by using the correction aids provided and explained for this in the ordering process. By clicking on the ordering button, you are submitting a binding offer to buy the products contained in the shopping basket. The confirmation of receipt of your order will take place by e-mail directly after sending the order.

As to when your offer will be accepted and the contract will be formed is subject to the chosen payment method:

Credit/Debit Card

By submitting the order you are sending us your credit card details at the same time. After your identification as the legal cardholder, we will ask your credit/debit card company to initiate the payment transaction and will thereby accept your offer. 

3. Contract language, saving of the contract text

The language available for concluding the contract is English.

The text of the contract will not be saved by us. 

4. Terms of delivery, reserved right to make partial deliveries

In the ordering process, you are responsible for ensuring that your information is accurate, complete and up to date.

We deliver only within the United Kingdom mainland, Channel Islands, Isle of Man and Northern Ireland. Customers who would like delivery to take place outside the areas mentioned above may contact the Vorwerk company or the Vorwerk partner in the country concerned.

In addition to the stated product prices, shipping costs £4.95 are added for each order for Next Day delivery. Orders having a value of £80.00 or more are shipped free of charge.

Where part of the order cannot be delivered immediately because we have not received the supplies ordered from our reliable supplier, without fault on our part and in spite of placing appropriate orders, we will deliver the remaining goods in an additional shipment without recalculating the shipping costs, insofar as this is reasonable for you. 

5. Prices and due date

The prices quoted in the online shop represent total prices including value added tax. The prices quoted at the time of your order apply.

The price is due upon the conclusion of the contract, unless the following terms of payment specify otherwise. 

6. Payment

The following payment methods are available in our shop.

Credit/Debit card

With the submission of the order, you are sending us your credit/debit card details at the same time. After your identification as the legal cardholder, directly after the order, we will ask your credit/debit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit/debit card company and charged to your card. 

7. Prohibition of commercial resale

Commercial resale is expressly prohibited.

8. Set-off and retention right

You are only entitled to a set-off right if your counter-claim is in a reciprocal relationship with our principal claim, is not disputed by us or has been legally established.

You have a right of retention only if your counter-claim is based on the same contractual relationship. 

9. Retention of title

The goods shall remain our property until full payment is made.

10. Damage during delivery

If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

11. Warranty and guarantees

We are under a legal duty to supply products that are in conformity with this contract. Statutory warranty rights apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product or on distinct information pages in the online shop, if applicable.

12. Liability

We shall in any case be liable without limitation for claims due to damages that have been caused by us, our legal representatives or legal agents

For breach of material contractual obligations, the fulfilment of which make the proper execution of the contract possible at all and which the contracting parties may generally rely on and trust in being complied with, due to slight negligence by us, our legal representatives or legal agents, the amount of liability is limited to the foreseeable damages at the time of contract conclusion, the occurrence of which must typically be anticipated.

Ceteris paribus, claims for compensation for damages are excluded.
